Bill Aims At Making Cell Phone Use While Driving Illegal

W. Va. Could Join Other States In Ban

A West Virginia lawmaker is looking to make talking or texting behind the wheel illegal in the Mountain State.

Kanawha County Delegate Nancy Peoples said the bill would improve highway safety in the Mountain State, but some people disagree.

"I think you should be able to talk on the phone, especially if you are stopped in traffic or an accident or something like that," said Dan Polce.

Others, though, said anything to take your eyes off the road is distracting and it's a law they could get used to.

"It would probably be like the seatbelt law. It would probably make some of us [stop] that only do it occasionally,” said Sue Weininger.

The bill would limit cell phone use to hands-free devices and it wouldn't apply to police, emergency responders or government officials.

"If they're talking to their wives while they're in the police cruiser, that's wrong. But if they're talking and calling ahead for help, that's fine," said Helen McClung.

There's no word on how many West Virginia accidents involve cell phone use because the Division of Motor Vehicles does not keep track.

The bill looks to make the violation a misdemeanor charge that would carry a $25 fine.
