A man convicted of robbery and running from police nearly four years ago was finally sentenced in a Belmont County courtroom Monday, but received no time in prison.Stewart Edward Sisley was convicted of robbing a St. Clairsville bank and stealing roughly $60,000 in September 2004.Sisley was also convicted of fleeing and eluding police, after leading them on a high-speed chase.Judge Jennifer Sargus gave a sentence of five years in prison to Sisley more than three years after his crimes. And according to the prosecution, Sisley will not serve any of that time in prison.Sargus considered his time spent on house arrest, after the crime committed in 2004, as time served. Also, Sargus suspended all other time not served already through house arrest. The sentencing Monday comes after a long list of continuations in the case.According to court records, Sisley's sentencing was continued for more than a year, nearly eight times. The prosecution told NEWS9 the court granted the continuances at the defendants' request. As part of the reasoning for the sentence, Judge Sargus explained the balance between punishment and rehabilitation. The defense argued that Sisley's alleged mental instability, his depression and anxiety issues, make prison a bad option for him.The prosecution had no comment on the outcome of the case, and the defense declined comment as well.Judges are not permitted to comment on the details of any case.
