College Student Cleared Of Bank Robbery; New Suspect Charged

Police Say DNA Evidence Led Them To Different Suspect

Rickey L. Henry Jr. went from being a student at West Virginia Northern Community College in Wheeling to an inmate in the Northern Regional Jail.

Until Friday.

Police had accused Henry of robbing the WesBanco Bank on Wheeling Island in August 2009. But, officials dropped the charges against him after they said DNA evidence led them to a different suspect.

Police on Friday arrested Patrick Zachary Zetka and said it was Zetka's DNA that matches clothing the bank robber left behind. The new arrest clears 28-year-old Henry's name, who told NEWS9 he "was ecstatic. Almost in tears. It was quite the experience." Ohio County Prosecutor Scott Smith said Henry was identified as the bank robber in a photo lineup. But later, the DNA testing determined that Henry was not the robber. As a result, all charges against Henry were dismissed, Smith said in a news release.

Zetka, 29, of Brownsville, Pa., is now charged with robbing the bank on Zane Street and stealing $4,250.

In a news release, acting U.S. Attorney Betsy C. Jividen said a sweatshirt and hat found on the riverbank later that day were positively identified by witnesses as being the robber's, and the sweatshirt had ink marks on the sleeve where a second teller had jabbed the robber with an ink pen while he was reaching into the money drawer.

A report was issued by the West Virginia State Police Crime Lab stating that the sweatshirt and hat submitted by the police following the robbery contained DNA evidence and that a match had been made to Zetka, who has a previous criminal record.

Zetka appeared before Magistrate Judge James E. Seibert Friday for his initial appearance and a detention hearing and was remanded to the custody of the United States Marshal pending a detention hearing to be held next week.

The case will be prosecuted by Assistant U.S. Attorney Randolph J. Bernard and was investigated by the FBI and the Wheeling Police Department.
