Timmy Hibbits Death Ruled Homicide By Jefferson County Coroner

The autopsy results are in on the death of Timmy Hibbits - who died in his home last month. Today the Jefferson County coroner has ruled the death of the two year old a homicide.

You may recall Timmy's mother - Eve Hibbits was arrested in 2002 when her children were severely sunburned at the Jefferson County fair. The case made national news - but the charges against her were eventually dropped.

Today the Sheriffs department and the Jefferson County Coroner held a press conference to release the information on the death of Timmy Hibbits. Hibbits died at his Dillionvale home on March 14th. According to the autopsy reports, there were 2 medical conditions at the time of his death: An acute bronchial pneumonia and an inner ear infection.

According to the coroner, neither one of these conditions by themselves contributed to the death of Timmy Hibbits. But Coroner, John Metcalf says that there were a group of "disturbing findings on the face which correspond with what an adult hand would have created when trying to muffle a crying child."

The actual cause of death is hypoxia-which in lamens terms is a reduced amount of oxygen. According to Metcalf, this was a result of Timmy Hibbits pneumonia plus an intentional upper airway constriction.

Today Sheriff Abdalla painfully said, he believes this death could have been avoided. "Thats the one thing the doctor said the day of the death," said Abdalla. "The sad thing is, they do have a medical card. And treatment was available. The problem was the child never got to go to the hospital...Until his lips turned blue"

On monday, Sheriff Abdalla will present Prosecutor Bryan Felmet with the information on this investigation. Felmet says that it is too early to say if the parents will be charged and for what? But he says charges could consist of child endangerment to various degrees of homicide.
