Injunction On Traffic Cameras
Major developments concerning those controversial traffic cameras in Steubenville. Monday a judge put a temporary stop on the use of those cameras. Attorney Gary Stern is representing his wife April who was issued a citation from one of the cameras. She says she is filing a lawsuit because she has problems with how the cameras were put up, "How they set this up did they do it legally and as Gary dug into it found they didn't and this needs to be brought out. If we need to follow the law so do they." Monday in court Stern argued the ordinance for the cameras says before the machines are used the city has to publish notice for 14 consecutive days in a newspaper. Stern says "the city didn't do that and admitted they didnt do that." An attorney for the city argued they did not have to advertise for portable units, just permanent cameras. The attorney also said the city simply wants to stop speeders. Monday in court the judge issued a temporary injunction preventing the city from enforcing these cameras until a full hearing can take place on the matter. That hearing is scheduled for January. So what happens if you get a ticket in the mail for a citation from last week? And what do you do with a ticket you are suppose to pay this week? NEWS9 talked with the judge who issued the injunction about what people should do now. Scenario #1: you get a ticket in the mail this week for a speeding violation last week or the week before. In this example, Judge Henderson says right now the city is currently not allowed to enforce these violations. Scenario #2: you have a ticket that is due in December. Again Judge Henderson says at this time the city cannot enforce these tickets. Both those scenarios begs the question: what about late fees if the hearing in January determines the tickets are legal. If your ticket is due December 5th on, Judge Henderson says late fees would be void during the injunction, you would simply have to pay your ticket in January. If your ticket was due before December 5th, and a late fee already applies, then you would still be responsible for that fee. What about the people who have already paid these traffic tickets? The judge says that matter is on hold until the hearing in January.
