Traffic Camera Tickets Ruled Invalid And Company Is Ordered To Pay Drivers

Tuesday Judge David Henderson ruled the traffic camera citations given to thousands of drivers in Steubenville are invalid.

He said it's because the defendant, Traffipax, and the city didn't comply with the ordinance and notify drivers prior to those cameras popping up.

City councilwoman Debbie Welsch says she's upset with the decision, but she'll head back to the drawing board. "We'll take the legislation, we'll fine tune it," said Welsch. "We'll make the wording correct, and of course we'll comply with that."

Another thing the city will have to comply with is Henderson's ruling that everyone who paid the $85 traffic camera ticket be reimbursed.

Many locals NEWS9 spoke to think the ruling was fair. "You should get reimbursed," said Weirton resident Jeremy Angelo. "I mean if they said they're invalid, there's no reason for them to give the ticket, you should get your money back."

"If I had a ticket, I'd want mine back," said Steubenville resident Bud Bensie.

One man we spoke to got two tickets, and said he didn't get a warning. "They don't post the sign and the sign is only like one foot square," said Mingo resident John Romanda. "And I think it's just a money making proposition for the city, that's all it was."

Welsch disagreed. "People constantly say that it was a money raising thing. That has never been nor is it now, the intent of the cameras. My No. 1 complaint in my ward is speeding."

Welsch said speeding remains the city's main concern, and she said the money will be given back to residents as ordered, but they aren't giving up.

"In the interim, we are looking at reimplementing the cameras."

The ruling won't be filed until Wednesday morning.

As for how much people will be getting back, Judge Henderson said he ordered restitution for the tickets, but he doesn't know if the full $85 will be reimbursed.
