Osaka seeks to stop opening of new Chinese restaurant

BELMONT COUNTY, Ohio

Osaka Japanese Steakhouse is threatening a lawsuit concerning the new Panda restaurant set to open in November outside the Ohio Valley Mall.

Chris Gagin, the attorney representing Osaka, says management at the mall agreed not to open any Chinese or Japanese-based cuisine as long as Osaka stayed in business at the mall.

Panda is set to open in November, just outside the mall, in the site of the former Quizno's restaurant. Gagin said that it violates the terms of Osaka's lease with the mall.

"This controversy is of the mall’s making. If they would have honored the lease, they could have brought in American, Italian, Mexican, anything, but under our lease, not Chinese or Japanese," said Gagin.

Ohio Valley Mall Company, which owns and manages the mall with the Youngstown based Cafaro Company, said they have not yet received a letter from Osaka or Gagin on behalf of Osaka.

They add that they will respond once they receive the letter and say they believe Osaka is mistaken.
