Update: Jury deadlocked in Fuller case

BELMONT COUNTY, Ohio – The The death penalty has been taken off the table and the fate of convicted murderer Devin Wayne Fuller is now in the hands of the court after the jury deadlocked and was dismissed Wednesday, the third day of the sentencing phase of the trial.

Fuller, 21, who last week was convicted of the aggravated murder of 92-year-old Lydia Ashworth, will hear his fate Thursday at 11 a.m.

The court has the option of choosing life in prison with the opportunity for parole after 25 years, or after 30 years, or life without parole.

Fuller's co-defendant Brandon Phelps will stand trial March 31.
