Suppression hearing held for sexual assault suspect

WELLSBURG, W.Va - A Brooke County Grand Jury indicted a man back in June on charges of sexual assault and today that man, Larry Hundagen, appeared in court for a suppression of evidence hearing.
 
The evidence in question was statements made by Hundagen a series of interviews from when the investigation began.
Friday, a judge allowed that evidence to be used in trial and NEWS9 learned more about how the case has got to this point.
It is alleged that back in 2008, Hundagen had sexual contact with a then 15-year old girl that he allegedly had sexual contact with.  
 
 “The sexual assault in the third degree is really an age-base type of crime, given the fact that the alleged victim was under the age of consent in West Virginia, which is 16,” special prosecutor Shawn Turak said. “She was 15 when this happened.”
 
In total, Hundagen faces two counts of sexual abuse by a parent/guardian or custodian, one count of third-degree sexual assault and third degree sexual abuse.
 
Hundagen could face at least 10 years in prison for the first two counts and an additional year for the third count.
 
The fourth count is a misdemeanor             
               
"They spent a lot of time at Seneca Lake, the victim's parents were caretakers of a boat club at Seneca lake, So they knew each other from that,” Sgt. Scott Adams of the West Virginia State Police said.
 
Hundagen’s defense asked that initial interviews be thrown out -- citing the constitutionality of how they were conducted.
 
“Ultimately, those interviews and specifically the statements made by Mr. Hundagen during those interviews will be available the jury will be permitted to know about the details in those interviews,” Turak said.
 
The trial is tentatively scheduled to begin Feb. 13, however that date is subject to change.
