Trial begins for man accused of sexual assault, giving 22-month old an STD

HANCOCK COUNTY, Ohio - A case of alleged sexual assault began Wednesday against a man prosecutors say gave a child an STD.
With his opening statement, Hancock County Assistant Prosecutor David Cross painted a picture of what happened in December 2012. The victim in this case was just 22-months old at the time.
Cross also revealed that while speaking with investigators, Graham gave five different stories of the incident, all varying drastically.
At that time, Tyler Graham had been dating a 20-year old woman.
Prosecutors say Graham was sleeping in the same bed with his girlfriend's 22-month old daughter and that's when the assault happened.
It was laid out by Cross in his opening statement.
"Ladies and gentlemen of the jury, this case is about a 19-year-old man that had sexual intercourse with a 22-month-old child and after he did it, he admitted it," Cross said.
Later that month the nearly 2-year-old appeared to be suffering from diaper rash. But further tests revealed it was far more serious.
This is when those statements from Graham come into play. From Feb. 8-11, Graham gave statements ranging from complete denial to saying he may have had accidental sexual contact with the child.
Those are statements the state says are contradictory.
"And when he told Mr. Graham that, Mr. Graham didn't say, 'Yes, I did it.' He just gave a shrug," Cross said.
The defense chose to defer its opening statements until the admission of evidence.
That hasn't taken place yet.
Before a brief recess, they had called one witness to the stand -- the girlfriend for questioning.     
This trial will continue Wednesday morning in Hancock County circuit court.
