Indian Creek ordered to pay Mays’ education costs

JEFFERSON COUNTY, Ohio – A judge ruled Monday it is the responsibility of the Indian Creek School District – and not that of the Steubenville School District -- to pay the cost of tuition for the education of Trent Mays, one of two Steubenville High school student athletes convicted of an Aug. 2012 rape.
Neither school district had been reporting Mays, 18, as a student leading up to what was called “the Re-determining of the Early determining of district responsibility” on Monday in Jefferson County Juvenile court in front of Judge Thomas Lipps.
Ohio law requires the court to determine the school district responsible to pay the costs of education for a student placed in governmental custody. It was determined that Mays and his parents lived within the boundaries of the Indian Creek School District “at all times.”
They applied for, and were, granted, open enrollment in the Steubenville City School’s District for the beginning of the 2012 school year. But before the school year began, Mays was charged with an offense and placed in the Jefferson County Detention Center.
Since that time, Mays has been in the detention center, in home restricted detention school, in a Department of Youth Services Institution, and in a DYS treatment facility, where he remains. He has received education in all governmental placements.
In March 2013, a court ruled Steubenville City School District was responsible for Mays’ education costs.
Monday’s ruling found the courts should have designated the school district of the student’s parents and residence as the district that bears the cost of education for Mays while he is in DYS custody (from 2012-2015).
The Ohio Department of Education is to adjust its records and allocations to rectify any loss by the Indian Creek School District due to reliance on the court’s original, incorrect entry.
