MARSHALL COUNTY, W.Va. - A Marshall County teacher who earlier Tuesday admitted to attempting to kiss a student and pursue a relationship with her was charged with five counts of possessing child erotica later Tuesday afternoon.
David Duane Will, Jr., 32, appeared in court Tuesday and pleaded guilty to one count of misdemeanor battery after his April 30 arrest. However, the Marshall County' Sheriff's Department seized Will's computer during its investigation of the battery charge and allegedly found sexually suggestive pictures of a person under the age of 16 on his hard drive, resulting in additional charges.
As for the original complaint, Will allegedly told the teenager she was beautiful, he missed her and repeatedly tried to contact her through social media before he attacked her on April 9. Reports indicated a computer was seized and his Facebook and Twitter account were deactivated.
The incident was reported to the Marshall County Sheriff's Department and the Marshall County Board of Education. The girl's sister also told deputies she witnessed the incident.
That case came to a close because the victim and the school board wanted closure. The young woman, who is now a college student, was OK with a plea deal.
Marshall County Schools Superintendent Michael Hince says Will is on unpaid leave and a decision on his future is expected soon. However, he will not return to school Wednesday.
Will faces 5 years in prison if convicted.
