Charges dismissed in child overdose death

OHIO COUNTY, W.Va. – Charges were dismissed in a case of Ohio County parents accused of neglecting their 3-year-old daughter.
Police say the neglect ultimately resulted in an overdose death.
Edward and Cindy Cole are both free and, right now, neither are facing any charges.
Patience Cole died at the Coles’ Wheeling Island Home in March 2012.
Cindy Cole has been accused of changing her story several times, but never went to trial. A mistrial in Edward's case was determined after jurors saw information that was not supposed to be disclosed. That information included the possibility the 3-year-old was sexually abuse.
Prosecutors say there is more work that needs to be done before this case goes before a jury.
"At this time, the state would move that for dismissal of the charges currently pending against Mr. Cole, based on the need for additional investigation and the state believes it would be in the best interest of justice to allow dismissal without prejudice and submit an order to the court,” Ohio County Assistant Prosecutor Jenna Perkins said.
The state still says the Coles should have prevented this tragedy by locking up the pills. Cindy Cole's case was dismissed Friday.
Edward did not show up for the dismissal of his charges. There is no word on if and when new charges will be brought up.
