Man sentenced for sexually assaulting handicapped woman

WHEELING, W.Va. --


A Wheeling man was sent to jail Thursday for sexually assaulting a mentally handicapped woman.

Joseph Jones was sentenced to 12-35 years in prison for three counts of sexual assault.

The assault against the 36-year-old woman happened in August 2012. Prosecutors said Jones lured the woman behind Warwood Middle School and attacked her.

"She had no capacity to consent by virtue of her mental retardation. She is a victim of every sense in the matter your honor. She has the equivalency of a child, with an IQ of 55-63," said Ohio County Assistant Prosecutor Shawn Turak.

Jones entered an Alford plea, meaning he's not admitting to the crime, but knows the state has enough evidence against him to convict him.

Thursday, Jones told the judge, "I think this is all wrong. I've been incarcerated for something I didn't do."

The judge told Jones, "Well, sir, you entered a plea," to which Jones replied, "I had no choice."

Turak said prosecutors have evidence from the state crime lab that has Jones' DNA on the victim.

"The fact that the defendant has failed to accept any responsibility of these crimes is very troubling in this matter and he sits here today and continues to say he did nothing wrong," Turak said. "He showed her no mercy and before this sexual assault occurred, he said he was going to teach her a lesson and she was going to get what she deserved. I think it's time for Joseph Jones to get what he deserves."

Jones will also be required to register as a sex offender for life and will be on probation for 50 years after he's released from jail.
