Robbery trial delayed for DNA in Ohio County

WHEELING, W.Va. -- A trial for a man accused of shooting another man in the head in May in Wheeling was set to stand trial. However, on Monday in court, that changed as both sides await DNA evidence the state says could tie the defendant, Treyvon Montogomery, to the crime.
According to reports, the victim told officers three men forced their way into his home and held him and his daughter at gun point while robbing them of marijuana and money. The victim's daughter told officers she recognized one of the men as Montgomery as he did not have his face covered.  She also says she heard the men use the name "Treyvon" at least once.
One of the men fire a shot at the man, hitting him in the face, though the female could not identify which of the suspects pulled the trigger.
In court Monday, there was talk of clothing and prints that may put Montgomery at the scene.
“This DNA was found on articles of clothing that were described by the victim to be worn by the assailant, and possibly on a gun,” Defense attorney Kevin Neiswonger said. “If it matched the description of the gun used by the assailant, and they were found in an apartment occupied, at least for a time period, by two other suspects in this case. So from Mr. Montgomery's perspective, if it ends up being their DNA and not his, we believe it’s exculpatory.”
It was also revealed Monday that Montgomery may have been involved in another robbery in Wheeling but very little was said in court.
Montgomery will be back in court for a pre-trial hearing on Oct. 3. His trial is now set for Oct. 14.
