WJU beating suspect in court

WHEELING, W.Va.—

Craig Tyler Peacock, 22, of Clewiston, Fla. was back in court on Tuesday.

Peacock will go before an Ohio County jury on April 29 for a charge of murder. He’s accused of kicking Kevin Figaniak, 21, during a fight on Aug 31.

Jarret Chandler, 24, of Winnfield, La, pleaded guilty last month to misdemeanor involuntary manslaughter. Jail administrators say he could be released from jail in April.

Police say Peacock, Chandler and a third man got into a fight with Figaniak and another Wheeling Jesuit University student after both groups left two bars in the Woodsdale area.

Chandler admitted to punching Figaniak after Figaniak allegedly pushed him.

The defense claims Figaniak's friend dropped him several times.

Tuesday several issues were addressed including autopsy photographs, the victim’s character and a fair and impartial jury.

Defense attorney Robert McCoid argued the media be excused from the courtroom during evidentiary hearings, but the judge refused.

A questionnaire is being made to be sent to potential jurors to determine whether or not Peacock can get a fair trial in Ohio County.

Peacock’s trial is set for April 29.
