Injunction request dismissed on B&O tax lawsuit

HANCOCK COUNTY, W.Va. – A move to stop the city of Weirton from going forward with a Business and Occupation tax just failed in a Hancock County court.
The owner of Tri-State Medical had filed suit against the city, seeking a temporary and permanent injunction to stop Weirton's City Council from even considering a B&O tax.
Ohio County Judge David Sims dismissed the suit, saying the court has no authority because the ordinance hasn't been enacted, and can't legally interfere with legislative process.
Weirton's City Council is supposed to bring the issue up tonight and vote on whether or not to move forward with that B&O tax proposal.
That meeting begins at 6:30.
