Two charges dropped in Fuller murder trial

Prosecutors say charges were duplicated


BELMONT COUNTY – Two charges have been dropped in the upcoming capital murder trial of 20-year-old Devin Fuller.

Fuller is one of two men accused of the brutal killing of a 92-year-old Bellaire woman in June, 2012.

Fuller is now charged with two aggravated counts of murder, committed during the course of rape and aggravated burglary. He is also charged with one count of aggravated burglary and one count of burglary.

The charges of murder in the course of trespassing and burglary were dismissed.

Prosecutors say both charges were duplicated, and the decision was made to simplify matters and avoid confusion.

Prosecutors say the same decision would like most likely be made in the trial of co-defendant Brandon Michael Phelps.

Meanwhile, jury selection continues inside the Belmont County Courthouse for Fuller’s trial. Nearly 40 jurors were extensively interviewed during the first two days of selection, with about 40 more remaining.
