Bellaire Woman Claims Mining Damaged House, Property

BELMONT COUNTY, Ohio —

Cathy Bell purchased her home in 1993. Her husband's great grandfather built the house in 1904. For a period of time, the house was owned by a non-family member who allowed Sidwell Materials Inc., to mine on and around the property.

"I was told by the original owner that they would be mining for a little longer, but they were in the final stages," said Bell.

The mining came to an end in 2000, but the problems began.

"In 2003, my whole yard turned into a pond," said Bell. She said she was forced to replace her kitchen floor and mold began growing in and around her house.

Bell said the ground became so soft, a local architect deemed one addition of her house unsafe.

The Ohio Department of Natural Resources is reponsible for the oversight of mining companies, and reclamation of property.

Bell said while ODNR has reclaimed portions of the property, they've left out the area around her house.

ODNR officials said the case is complex, but that all the mining done on the property was legal. They told NEWS9 though unfortunate, it appears Bell purchased the house without proper knowledge of the mining lease signed by the previous owner.

ODNR also told NEWS9 they inspected the property in July, and those reports will be sent to Bell and her attorney by mid-October.
