Bond revoked for Weirton man accused of sexually abusing 2-year-old

HANCOCK COUNTY, W.Va. —

The bond of a Weirton man accused of sexually abusing a toddler was revoked on Friday for a probation violation.

Tyler Graham, 19, is facing one count of sexual abuse of a minor. He is accused of having sexual intercourse with a 2-year-old and giving the toddler a sexually transmitted disease.

On Friday, a hearing was held in Hancock County Magistrate Court held the hearing after accusations surfaced that Graham may have violated his bond.

The prosecutor presented evidence that Graham violated the terms of his bond by being in a car that was near the home of the toddler's family. He said part of the bond condition was that Graham was not to be in contact with the victim or any witness, directly or indirectly.

The prosecution called two witnesses, and said that Graham has been in the vicinity adjacent to the property of the mother of the child. The prosecutor said the information he had is that Graham was there to pick up a friend and there was no direct contact, but said it was still an intimidation factor.

Graham's attorney argued for tighter restrictions by keeping his client 500 feet away from the home. The attorney said Graham did not get out of the vehicle and never tried to make any kind of communication, either directly or indirectly.

But Magistrate Mike White said the state's case convinced him.

"At this point I think the state has proven its case. You've just got to follow the rules. And since he hasn't followed the rules, we'll make sure he's here for court and there's no further intimidation," White said.

The judge ordered that Graham be sent to the West Virginia Northern Regional Jail, where he will remain until his next scheduled court hearing on March 29.

When Graham was arrested in February, Weirton police Detective Gerard Spencer said this is "probably one of the worst cases I've seen being here" and said more charges could be filed.

Spencer said relatives first thought the toddler had a diaper rash, but learned from doctors it was something else. Police said they were contacted by Weirton Medical Center after the 2-year-old had surgery for wounds related to sexual abuse.
