Brooke County teacher fired

WELLSBURG, W.Va --

Former Brooke High School teacher Zak Harvey has been terminated, according to a member of the Brooke County School Board.

At Wednesday night's special Board of Education meeting, the board voted to terminate him on multiple allegations by students, according to Harvey.

He said in August, he was notified that he would be suspended without pay for 30 days. About a week later, he was notified that the board was planning to increase his punishment, he said.

According to Harvey, many of the allegations presented at Wednesday's meeting were hearsay.

However, he said one instance happened last year, when a student said he wanted to be a porn star.

"I said jokingly, 'When you get that money, I'll manage you,'" Harvey said.

He said the incident was brought to the attention of the school's principal, and it was added to a file. Last night, he said the entire file was presented to the board, which included complaints that dated back to before 2008.

Frank Caputo, Harvey's representative from the state Federation of Teachers, said he believes the firing was done illegally, because Harvey was already punished with a 30-day suspension.

"The code that allows them to suspend, terminate, and so forth -- there's nothing in that code that authorizes multiple disciplinary actions for a single act.

"We've never faced a situation where a board has approved a 30-day suspension, then brought him back in to possibly terminate him. The point I want to make is ... in our opinion, they have snubbed their nose at his rights. They've decided, no matter what, they were going to terminate him," Caputo said.

Caputo also said during closed discussions between board members, the board's attorney was also present, which he believes was unfair.

Caputo and Harvey said they will appeal the decision.

No school officials were available for comment.
