Competent To Stand Trial

Thursday a Brooke County judge ruled a local man is competent to stand trial in a sexual abuse case. Police arrested 28 year old John Sousa of Toronto. Investigators say in July of 2004 he sexually abused a five year old girl. What complicates this case, and why it has taken so long to get to trial, is a question over the suspect's mental state. Before a trial could move forward, a judge ordered Sousa to undergo a mental competency evaluation. According to court documents the doctor diagnosed Sousa with mild mental retardation. Thursday a judge ruled based on the evaluation Sousa is competent to stand trial.
