Court litigation no hindrance in ongoing bridge demolition battle

BENWOOD, W.Va.-- Documents and permits have been missing and then filed. Deadlines have passed and then been extended. Conditions for the Bellaire Bridge demolition have been in flux.

 

Tuesday, NEWS9 learned more about some court litigation surrounding the bridge which could also play into its ultimate fate.

 

NEWS9 has clarified two pieces of court litigation long involving the Bellaire Bridge, and thought by some to be holding up the demolition process.

 

A ticking clock looked like it was going to be a time bomb for bridge owners KDC Investments and contractor, Delta Demolition, until the United States Coast Guard and Norfolk Southern Railroad Company backed off  legally.

 

The Coast Guard and the railroad both said additional time would be given to the owners for their good faith efforts at getting the necessary documentation to remove the bridge.

           

"Norfolk Southern, last time I spoke with them, they were OK with that, and they essentially had no objection to an extension on the amount of time it would take for removal of the bridge," said Peter Sambor, USCG bridge management specialist.

 

The Coast Guard oversees the entire bridge and its removal, and in July 2012 they submitted a conditional approval letter to the bridge owners to enable demolition. But, it’s still standing.

 

"I had a project recently up in Minnesota that actually was 27 years in the making. It actually took a signature by the president and a congressional act in order for the project to move forward," said Sambor.

 

Coast Guard approval, courts out of the picture for now, but still, the burdensome bridge has no deadline date for demolition as some sides of the saga remain unsatisfied.

 

"The portions of the bridge over land, although we do have jurisdiction over them, we actually defer to the state and local entities," said Sambor.

 

As a result, permits and licensing required by the city of Benwood to give Delta Demolition the green light, have left the process at a stalemate.
