Double murder defendant, 16, faces juvenile judge

STEUBENVILLE, Ohio —

One week after two men were gunned down outside the Heritage Apartments in Steubenville, the suspected 16-year-old shooter faced a Jefferson County juvenile court judge.

NEWS9 is not releasing the defendant's name because he is still being processed in the juvenile court system. He is from Steubenville.

Under state law, if the judge finds probable cause, the teen defendant will be transferred to Common Pleas Court where he will be tried as an adult.

Police believe the suspect shot and killed Otavius Wilson, 19, and Ryan Toson, 21, Jan.30. Both men were found lying on the ground outside of 815 Market Street with gunshot wounds. Both later died at the hospital.

Police arrested the teen defendant early the following morning and he has been in juvenile detention since then.

Prosecutors have not speculated on a motive for the killing, but members of Toson's family said neither victim was the type to go looking for trouble.

"Ryan, on several occasions, if he ever had a problem, would walk away from it," said Cinque Reed, Toson's uncle.

Toson's aunt credited police and witnesses for the suspect's quick capture, and urged others to report crimes to prevent further violence in the city.

"It's not the police. It's not the city," said Toson's aunt, Alex Robertson. "It's more or less people just not saying stuff."

A woman, identified by the judge as the teen's grandmother, was present for the arraignment Wednesday, but she did not speak to reporters or the court.

The defendant faces sentences of 15 years to life on each murder charge plus two additional charges because police say he used a gun. Because of his age, he is not eligible for the death penalty.
