The car rolled over, injuring the driver and the child. Investigators said they believe the passenger in the car intentionally caused them to crash.
Investigators said they believe a passenger was drunk and after an argument tried to grab the steering wheel, forcing the car to flip over.
The 2-year-old was in the back seat, police said.
Marshall County Sheriff John Gruzinskas said charging passenger Robert Carney, of New Martinsville, the passenger, was tricky because Carney was drunk and, even though he was not the one behind the wheel, he did take control of the vehicle, so Carney is facing several DUI charges with injury and unlawful assault charges.
The driver, Jamie Luff, and her 2-year-old son were transported to Ohio Valley Medical Center for treatment.
Carney is being held at the Northern Regional Jail awaiting arraignment.
