OHIO COUNTY, W.Va. --

West Virginia Supreme Court Justice Menis Ketchum has denied a motion ordered by former Wheeling police Officer Matthew Kotson's attorney, Robert McCoid, to disqualify Senior Judge Arthur Recht after recent comments Recht made about the case in court.

In an administrative order issued Thursday, Ketchum denied the motion, saying there was not enough evidence to support it.

Kotson's trial is set for Sept. 4 in Ohio County. He will be tried for counts one and two of the eight-count indictment. Both counts are sexual abuse in the first degree.
