The threat of legal action against the Apex Landfill appears to be working for the JB Green Team.

The Apex Landfill had fallen hundreds of thousands of dollars behind on payments and as a result team members agreed to file a civil lawsuit and pursue criminal charges against the company last week.

On Monday, board chairman Bob Chapman announced that Apex Landfill made a substantial payment and plans to make another that would catch them up this week.

If that payment is made, Chapman says the group will reevaluate its plans against the Apex Landfill.

"Before we proceed any further with the legal proceedings, we will wait until the end of the week to see if they make the next step," said Chapman. "It doesn't seem reasonable on our end to continue making their payments as the contract has been agreed to."

Chapman also said if the payment is not made the team is more than ready to move forward with the suit and charges.
