Judge Says Guidelines On Limited Video Lottery Advertising Unconstitutional

A court ruling has declared restrictions on video lottery adverstising is unconstituional.

Limited video lottery business owner, Chris Wakim, said the 2004 law that prohibited certain words on LVL signs took away his rights as an American.

On Friday, a judge granted a temporary injunction saying those restrictions are unconstitutional.

Wakim said business owners have won a long-debated battle.

Wakim said, "I think it's a good step forward for business owners and certainly for the citizens of West Virginia. It's clearly a victory for LVL owners."

Some people in the valley say this was not an issue of freedom of speech and as long as money was being made at the businesses, owners should be happy.

Kathleen Ivaun said, "I don't see how it could affect their rights because it seems as though the businesses are busy all the time."

Ivaun said the law to restrict advertising was ridiculous and should have never been passed.

While some business owners said the judge's decision will boost business, Wakim said it won't affect revenue and the fight was about freedom of speech.

The American Civil Liberties Union sued the State Lottery Commission in February about the ban.
