Judge: Student-athletes accused of rape will not be tried separately

JEFFERSON COUNTY, Ohio —

The attorney for one of two Steubenville High School student-athletes charged with rape said a judge has declined a request to give the defendants separate trials.

According to The Associated Press, attorney Walter Madison confirmed on Tuesday that the visiting judge handling the case in juvenile court in Steubenville had denied the request.

The Ohio Attorney General's Office did not comment.

In addition, several motions have been filed from attorneys on both sides. Attorney Robert Fitzsimmons filed a motion on behalf of the teenage girl who is the alleged victim at the center of the case. Fitzsimmons wants to close the trial to the public.

Adam Nemann, the attorney for one of the suspects, filed a motion on Friday to delay the trial. Nemann is expected to file an additional motion this week for a change of venue.

Earlier this month, defense attorney Madison filed similar motions. Madison also requested to close the trial to the public.

A hearing on those motions is scheduled for Friday and NEWS9 will be there.

The non-jury trial for the two student-athletes accused of raping the juvenile girl is set to begin on Feb. 13.
