Jury Gets Case Of Man Charged In Triple-Fatal Crash

OHIO COUNTY, W.Va. —

The case of a man accused of intentionally causing a triple-fatal crash is now in the hands of a jury.

After three days of testimony, closing arguments were heard Wednesday in the case against David Hancher-Palmer.

The final witness took the stand, and an accident reconstruction scene was created to show the jury what police said happened in Ohio County eight months ago.

Hancher-Palmer, 22, of Rayland, is charged with four counts of malicious assault and one count of leaving the scene of an accident with death. The latter charge is what the defense focused on.

"He called 911 50 minutes later. I know he said it was sooner, but 50 minutes later. Not five, not 10. Fifty minutes later," said Joe Barki, assistant prosecutor for Ohio County.

Defense attorney Kevin Neiswonger told the court about an ongoing fight between his client and Justin Wright, one of the victims who died in the crash. Neiswonger said Wright wanted to hurt Hancher-Palmer.

"I think the evidence clearly shows that Justin Wright wanted to hurt David Palmer. He said it. He said he was going to go to jail. He was going to do it," Neiswonger said.

There was much emotion in the courtroom as the only survivor of the crash, Justin Wright's sister, Ashley, and other family members of those killed sobbed through the court proceeding.

Ashley Wright, 23, of Toronto, was severely injured in the Jan. 30 crash that took the life of her 29-year-old brother. Brittney Lynn Kusic, 26, of Weirton, and Steven Carpenter, 20, of Toronto, also died in the crash.
