Building Code Board of Appeals sends hotel owner to court

WHEELING, W.Va.—

The Wheeling Building Code Board of Appeals sent Mark Jaber, owner of the Rogers Hotel back to municipal court after he failed to comply with their requests to repair the building and have a scope-of-work schedule presented to them in a timely manner, the board said.

Jaber said in the meeting he thought he was only to comply with what was issued in a raze-or-repair order the city gave him months ago.

City Solicitor Rosemary Humway-Warmuth said the city had been more than lenient, giving Jaber time to come up with a timeline of work and to hire an architect to design floor plans, and suggested the board send the matter back to municipal court.

"After inspection, I would say 5 percent, if that, has been completed in this project," said Wheeling Chief Building Inspector Frank Wilson.

The board voted unanimously to send the matter to court. Jaber will have to appear once all paperwork is filed. At that time, it will be up to the judge to decide what is next for the building and its progress.
