City files motion to dismiss injunction filed by FOP

By Philip Stahl

WHEELING, W.Va.—

The City of Wheeling has filed motions to dismiss the injunction that was filed by the Wheeling Fraternal Order of Police Lodge No. 38 last month.

City Solicitor Rosemary Humway-Warmuth said that the city had 30 days to respond to the injunction dated Oct. 17, and they did that Wednesday.

Humway-Warmuth cited that the injunction was false and certain dates and procedures to the city council meetings were inaccurate.

The civil matter has been assigned to Judge Ronald Wilson. No court hearings have been set yet.

Wheeling voters decided last week to repeal the two-officer per cruiser ordinance 63 percent of the vote to 36 percent.
