Federal Court orders Bellaire Bridge owners to secure bond by June

BENWOOD, W.Va.—

The U.S. District Court for the Southern District of Ohio has ordered KDC investments, the owner of the former Bellaire toll bridge, to pay $5,000 for contempt of court.

The order, issued by Judge Algenon L. Marbley, tells the owners to secure a $1 million bond required to obtain a demolition permit from the city of Benwood by June 20, 2013.

If KDC fails to secure the bond by then, the court ordered the company pays $1,000 daily.

"I was very surprised to learn this today," said Benwood Police Chief Frank Longwell.

The court order comes after a dispute between the bridge owner and Norfolk-Southern railroad, who claims a pier of the bridge, lays on their property.

Longwell said that they have not heard from KDC Investments or their attorneys in quite some time, but said that once a bond is secured, it will have to go before City Council.
