WHEELING, W.Va. —

Gov. Earl Ray Tomblin has appointed Rocky Fitzsimmons, a Wheeling lawyer, to the vacant West Virginia state Senate seat.

Fitzsimmons is co-chairman of Ohio County's Democratic Party and represented West Virginia University when it sued Rich Rodriguez over his departure as head football coach.

Fitzsimmons' appointment will begin in February.

He'll serve the rest of Orphy Klempa's term. Klempa left the Senate to take a position as Ohio County commissioner.
