Man accused of killing elderly Bellaire woman waives right to speedy trial

BELMONT COUNTY, Ohio —

One of two men accused of killing an elderly Bellaire woman waived his right to a speedy trial at a hearing on Monday.

Brandon Phelps, 20, is charged with four counts of aggravated murder, one count of burglary and one count of aggravated burglary. Each aggravated murder charge carries a possibly death sentence.

On Monday in Belmont County Court, Phelps waived his right to a speedy trial at a hearing in front of Judge Jennifer Sargus.

Police said Phelps and his alleged accomplice, Devin Fuller, killed 92-year-old Lydia Ashworth when they burglarized the woman's Bellaire home in June.

Fuller, 19, is charged with the same crimes as Phelps. He was arrested in October in Ohio County, while Phelps was already in the Belmont County Jail on unrelated charges.

Both suspects previously pleaded not guilty in connection with Ashworth's killing.

Officials said the investigation into the case is ongoing and a pretrial hearing was set for Jan. 7.
