Man sentenced in connection with fatal Marshall Co. crash

MARSHALL COUNTY, W.Va. —

A 20-year-old man was sentenced to prison on Wednesday in connection with a fatal car Marshall County crash.

David Schwing pleaded guilty to one count of involuntary manslaughter in July. Magistrate David Buzzard sentenced him to the maximum penalty of one year in prison and a fine of $1,000.

Schwing will not be spending all year in jail because the magistrate broke up the sentencing. He will have to report to jail for 45 days and the rest of the time will be split between house arrest and probation.

In October 2011, Schwing was driving on the wrong side of U.S. Route 250, about four miles south of Moundsville, when his car struck a van head-on. His passenger, Arthur Woods, was pronounced dead at the scene. Schwing suffered minor injuries.

Woods and Schwing were each 19 years old at the time of the crash.

Last year, toxicology reports were submitted by Schwing to see if alcohol was a factor, and those tests came back negative.

During Wednesday's hearing, Schwing's mother told the court how her son and Woods were best friends. Prosecutor Jeff Cramer also read a letter from Woods' mother, who said she has gone through so much grief over the last year.

Cramer read, "To explain the impact arts death has had on my life is practically I'm impossible. I've thought through everything I wanted to say a thousand times since his friend made a reckless decision that took him from me. The emotional and physical impact of arts death has forced me to live a life that I don't recognize."

Schwing also addressed the court, saying, "I miss him everyday too. Every weekend we were together one way or another, through school, whatever it was, we were there for each other. It was an accident, no one intended for it to happen."

Schwing will report to prison within the next 20 days. Once he is released, he'll be on one year of supervised release.
