Man who raped 12-year-old girl sentenced in court

OHIO COUNTY, W.Va.—

David Maya, 24, was sentenced to 6 to 25 years in jail Tuesday by Judge David Sims in Ohio County.

Maya raped a 12-year-old girl last June on the river bank on Wheeling Island.

Maya pleaded guilty to three counts of third-degree sexual assault and one count of abduction with intent to defile. Those are lesser charges than the original four counts of second-degree sexual assault.

Ohio County Assistant Prosecutor Shawn Turak said that the matter was set to go to trial, but the victim did not wish to go forward.

"The victim in this matter was having a lot of emotional difficulty in the aftermath of this rape and I didn't want to put her through that. We gained her trust as law enforcement and that matters to us because they were happy with the terms of the deal," said Turak.

Maya, who never spoke a word, sat in court with a Spanish translator as the victim's parents spoke directly to him.

"At first I didn't understand why he did it and picked my daughter. I still can't figure it out; I don't think I'll ever know. But, I do know this, no means no, even in Spanish," said the victim's mother.

Maya will be on 50 years of supervised release after he gets out of jail.

Turak said that during the investigation, it was discovered that Maya was an illegal immigrant; therefore, he could be deported once he serves his sentence.
