Marshall Co. elections report shows wrong projected winner in commissioners race; Canvassing will reconvene Wednesday

MARSHALL COUNTY, W.Va. —

Even though elections were a week ago, the fallout continues in Marshall County after a controversy about ballot counts.

A cumulative report that was sent to candidates and the media on election night had incumbent Democrat Jake Padlow in the lead by 60 votes.

But on Saturday night, while preparing for a ballot canvass slated for 9:30 a.m. today, County Clerk Jan Pest realized that nearly 3,000 absentee and provisional ballots had not been added to the cumulative report.

After those ballots were added, the report showed Republican challenger Bob Miller with an 80-vote lead.


"To my understanding they were there they just hit a wrong total button so I've been the commissioner-elect since Tuesday," Miller said. "We'll see if this continues and I become the commissioner or not."

The canvassing was delayed for a couple of hours when Padlow requested that the county prosecutor be present. Canvassing was expected to go well into the evening, and no official winner will be declared until canvassing is complete.

With regard to the mistake about sending out the incomplete report, Pest said, "We definitely won't do that with the cumulative report again. That's for sure. It was just a human error. The wrong box was checked and I regret it completely, but it is what it is."

Padlow was not available for comment on Tuesday and his attorney, Dan Guida, of Weirton, was at the canvassing proceeding.

State officials said they will only get involved if anything illegal is found.

Canvassing will reconvene on Wednesday at 4 p.m.
