Marshall County, WV —
Three weeks have passed since the election and three weeks later, Marshall County is still waiting to find out who will officially win the commissioner's race.
After a county-wide canvass, Bob Miller was declared the winner, but his victory was by a slim margin, just 70 votes.
That plus an incomplete report that showed him ahead on election night, prompted incumbent Jake Padlow to ask for a recount.
The recount will start in the basement of the courthouse at 1p.m. Tuesday and after a team hand-counts two precincts everything will move upstairs where the remaining 43 precincts will be run through a computer to determine who the winner is.
After weeks of waiting it seems like everyone is ready for the commissioner's race to be over.
"I'm just sick of hearing about the politics," said Cam Miller. "I think they need to pick the winner and get it over."
"I just think the election is done and over with, let it be done," said Toni Hoge. "Just let it be done."
Before it can be over with the county must complete a recount, which will likely mean the end of incumbent Padlow's time in office.
"You can't recount anymore and we can't go back and recount again so if there is any dispute that any party feels they were wronged they will have to go through a different process," said County Clerk Jan Pest. "We are done counting ballots."
"Once those numbers are certified we'll declare a winner and let the chips fall where they may at that point in time," said County Commissioner Donald Mason.
The process shouldn't take any longer than the canvass that the county conducted and will be pretty similar.
"The recount they can stop at anytime. A canvass, you canvass all the votes again," said Pest. "It's complete."
Pest says we shouldn't expect anything different this time around.
It is still unclear if Padlow will pursue any legal action if the recount doesn't come out in his favor. NEWS9 has tried to get in touch with him several time since the canvass but our calls haven't been returned, but we do know that attorney Dan Guida now represents him.
