OHIO COUNTY, W.Va. —
A motion for a woman accused in connection with her infant son's death got heated when the prosecutor asked for the woman's attorney to be dismissed from the case on Thursday.
Robin Reed is charged in the January 2011 death of her infant son as a result of abuse or neglect.
The battle between the attorneys was evident last month during a court hearing. At that time Reed's attorney -- Don Tennant -- said Reed was offered a lie detector test by a Wheeling police detective with the apparent approval given by Ohio County Prosecutor Scott Smith. Tennant said that if Reed passed the lie detector test, he thought all charges would be dismissed.
Reed passed the lie detector test, but was later indicted by a grand jury.
A few weeks ago, Tennant had Smith subpoenaed to testify in the case regarding the issue, but Smith refused and said Tennant is harassing him.
On Thursday, Smith said he wants Tennant -- who also serves as the Ohio County Commission's part-time solicitor -- dismissed from the case, citing several conflicts of interest.
Smith told the judge about recent budget meetings between himself and the County Commission, in which he and Tennant are both employed. Smith cited a discussion at a commission meeting in which Smith was asked if the prosecutor's office should be doing more for the county commission, and said he believes those incidents at commission meetings are in retaliation for the Reed case.
