ONLY ON 9: Pharmacist won't be charged in connection with robbery-related fatal shooting

WHEELING, W.Va. —





A pharmacist who shot and killed an armed robber in Wheeling in May will not be charged.

West Virginia State Police have completed their investigation, and Ohio County Prosecutor Scott Smith said the pharmacist's actions were justified in the fatal shooting.

Investigators said Kevin Walnoha showed a gun and tried to rob the Elm Grove Pharmacy on May 25, but he was fatally shot by a pharmacist.

Smith said because the pharmacist was a victim in the case, his name will not be released.

State police are charging Melody Fisher with one count of robbery and one count of conspiracy to commit robbery. If convicted, Fisher faces a minimum of one to 11 years in prison, Smith said.

Police said Fisher sand Walnoha acted together, and Fisher later admitted she was with Walnoha before the robbery and essentially was the getaway driver.

Fisher was arrested last month and taken to jail, where she remains. Her case has been bound over to the September term of the Ohio County grand jury.

Wheeling police are still investigating whether Fisher and Walnoha were involved with a robbery at the Warwood Rite Aid a week before the Elm Grove Pharmacy incident.
