Parents Will Stand Trial In Child's Death

Two-year-old Timmy Hibbits Died In March After A Case Of Pneumonia. Today, His Parents Found Out They Will Have To Defend Themselves In Court.

The grand jury says there's enough evidence to try Richard and Eve Hibbits on charges of reckless homicide and child endangerment.

The baby had a fever of over 100 degrees for days before his death. We tried to talk to the couple today. They refused to answer the door when we came knocking. Shortly later, the sheriff's department arrived at the Hibbits' home to deliver the couple's summons to appear in court. It wasn't until our cameras were out of sight that the Hibbits came out of their home to talk to the sheriff's deputy. Although the Hibbits avoided us, neighbors weren't afraid to talk to us about the events of the day of Timmy's death. Annette Goff lives right across the street from the family. She had been inside the home and says the Hibbits were unfit parents.

"The babies crawled around in feces!" she told NEWS 9.

She says the child's death was no surprise. She tells NEWS 9 the baby was ill since January.

"She didn't want to take him to the hospital," Goff says.

According to the coroner's report, the two-year-old died of pneumonia and an intentional airway constriction.The hibbits have three other children who are in the custody of relatives. Two of those kids also had pneumonia.

"They need to put her in jail," Goff says. "She doesnt need to be a mother."

Eve Hibbits was arrested in 2002 after her children were severely sunburned at the Jefferson County fair. Charges against here were later dropped.

The couple will be in court Friday.
