Police: Magistrate's request 'rare' for school administrators accused in DUI-related incident

OHIO COUNTY, W.Va. —

Police tell NEWS9 that an Ohio County magistrate made an "irregular" request after two Marshall County Schools employees were accused in connection with an alleged drunken driving incident in Wheeling,

The incident happened on Nov. 10, but NEWS9 was able to confirm the information from police on Monday.

Police said John Marshall High School principal, and Ohio Valley Athletic Conference President Corey Murphy and Director of Special Education Shelby Haines were driving in Wheeling when they struck a sign and left the scene.

Police said witnesses reported a woman was driving, but when police caught up with the car parked down the road, a man was behind the wheel.

"Our officers checked the area, found the Jeep in question, saw that it had been damaged. They find a male behind the wheel who was parked and a female who was in the passenger seat," said Deputy Chief Martin Kimball of the Wheeling Police Department.

While at first claiming that's what happened, Kimball told NEWS9 both suspects eventually confirmed witness accounts that Haines was driving.

"Both subjects were intoxicated. The female failed all field sobriety tests and was arrested for DUI and leaving the scene," Kimball said.

Haines was arrested and charged with driving under the influence and fleeing the scene, while Murphy is facing a charge of failure to provide a license.

During processing, both were said to be very difficult with police and dropped several names – one of which was Magistrate Patricia Murphy.

Next, police say the two officers were en route to the Northern Regional Jail, with Haines in the back seat. The phone rang, and it was Patricia Murphy.

"They took her in front of Magistrate Murphy, who apparently decided that Ms. Haines was too intoxicated to be arraigned as she was literally falling down. And the magistrate decided to take custody of the arrest and said that she would take care of her and told her to come back in the next day to be arraigned, which is highly irregular," said Kimball.

Police further said that Patricia Murphy asked that her name be left out of the police report.

Marshall County School officials and Corey Murphy each said they have no comment at this time. Haines attorney also declined to comment.
