Smoking Check

The Wheeling-Ohio County Board of Health says they are stepping up the enforcement and are now conducting surprise visits to restaurants.

After the visit, 8 out of the 10 restaurants and bars where found to be out of compliance.

The health officer Dr. William Mercer says the violations ranged from simple signage problems to out right smoking in the open.

Dr. Mercer says the crack down comes as they continue to get complaints on certain restaurants. The Keg and Kraut restaurant in East Wheeling, Winner's Circle in Dallas Pike, Wakim's Bar and Eagles both in the Elm Grove section of Wheeling.

Mercer says they could face hefty fines.

We'll becoming back at some point to recheck and if they're still not in compliance then the next step we will consider going to magistrate court for a monetary fine up to $1,000, said Dr. Mercer.

Mercer also says during the next board meeting they will address the concerns over the video lottery rooms where smoking is allowed. Mercer says some restaurants are creating a sort of smoking room. Dr. Mercer says they plan to continue the surprise checks.

All of those found in violation this weekend will first receive a letter. If violators are found out of compliance for a second time they could go to court.
