Special prosecutor appointed in case of former policeman charged with sex crimes

WHEELING, W.Va. --

 

Assistant Hancock County prosecutor David F. Cross has been assigned to be the special prosecutor in the case against a former Wheeling police officer who is charged with sex crimes.

 

Matthew Kotson was arraigned last week and is facing several sexual assault-related charges against two women.

 

Earlier this week, city manager Robert Herron fired Kotson from his job at the Wheeling Police Department. Kotson served on the force for eight years.

 

A preliminary hearing is set for Dec. 20 in Ohio County Magistrate Court, and Kotson remains free after posting $40,000 bond.

 

Ohio County prosecutor Scott Smith recused himself from the case.  The court first appointed Hancock County Prosecutor Jim Davis to the case, then Davis assigned it to Cross, who is one of his assistants. Cross is an assistant prosecutor in both Hancock and Brooke counties.
