Texting while driving ban in effect in W.Va.

WEST VIRGINIA —

Drivers in West Virginia will receive tickets if they are caught texting behind the wheel Sunday.

The texting and driving ban is in effect, making it a primary offense. Thirty-nine states now ban texting while driving.

"If police see you texting and driving, they can stop you, pull you over and give you a ticket," said Gov. Earl Ray Tomblin. "I just ask you, don't do it because a ticket will probably be the best thing that can happen to you. You can really actually lose your life."

Drivers will pay a $100 fine for the first offense. Using a cell phone without a hands-free device is a secondary offense until July 2013, and then it will be a primary offense.
