Wheeling Pitt Files Breach Of Contract Lawsuit

A local steel giant is seeking millions of dollars from an energy giant in a breach-of-contract lawsuit.

Opening arguments were made Thursday morning in a Brooke County courtroom in a lawsuit filed by Wheeling Pittsburgh Steel against Massey Energy and a company it controls.

Wheeling Pitt filed the lawsuit two years ago, claiming Central West Virginia Energy Company, a company controlled by Massey Energy, didn't live up to its end of a contract that goes back to 1993.

Wheeling Pitt said the company failed to supply enough coal to the Follansbee Coke Plant in a timely fashion.

Wheeling Pitt said the lack of coal eventually led to damages to the coke ovens as well as forced the company to pay higher prices for coal elsewhere.

Wheelin Pitt attorney Dave Fawcett said the company is seeking between $100 and $200 million dollars in damages.

Massey Energy attorney Henry Jernigan said he believed his company abided by the contract and provided the coal that was required.

The trial is expected to last as long as five weeks.
